wecade Terms of Use

1. Purpose
These terms govern the use of the wecade Android application (the "Application"), a game console emulator, published by Cédric Legrand, sole proprietor (EI), registered office at 1 ter rue des Tanneries, 01130 Nantua, France, registered with the Bourg-en-Bresse Trade and Companies Register (R.C.S.) under number 839 645 355 00026 (the "Publisher").
By installing or using the Application, you accept these terms. If you do not accept them, uninstall the Application.
2. Description
wecade lets you run games from third-party consoles on an Android device and play with others over a local network, including through emulation of the Link cable.
The Application can be downloaded for free and is funded by advertising displayed within the Application. A one-time purchase at a fixed price unlocks the Platinum features.
The Application's features may change, be modified, or be removed over the course of updates.
3. Games, ROMs, and BIOS
- wecade is emulation software. The Publisher does not provide, host, or distribute any game, ROM, disc image, or BIOS protected by copyright.
- You are solely responsible for the content you import into the Application. You represent that you lawfully hold the rights to it or are authorized to use it (for example, a backup copy of a game you own, or a work free of rights).
- It is prohibited to use wecade to reproduce, share, or distribute content in violation of the rights of its owners.
4. License
The Publisher grants you a personal, non-exclusive, non-transferable, revocable license to use the Application for non-commercial purposes.
You may not:
- copy, modify, decompile, or disassemble the Application, except to the extent permitted by law;
- resell, rent, sublicense, or redistribute the Application;
- circumvent its technical protection measures.
5. Local network multiplayer
Multiplayer works only over a local area network (LAN) between the players' devices. No game data passes through any Publisher server, and the Publisher has neither access to games in progress nor any means of moderating them.
- You are responsible for your local network and the devices you connect to; only join games with people you trust.
- Session quality depends on your network and your devices; no performance is guaranteed.
- Each player must lawfully hold the rights to the games used (see §3).
6. Saves and data
Saves and game states are stored locally on your device. You are responsible for keeping them: they may be lost upon uninstallation, reset, or device change, or following Application updates.
The free version displays advertisements provided by third-party partners, which may collect certain data (advertising ID, etc.) in accordance with the terms and choices described in the privacy policy.
Personal data is processed in accordance with the privacy policy.
7. Intellectual property
The Application and the wecade name and logo are the property of the Publisher or its licensors. No rights are transferred to you other than the license in §4.
Console, brand, and game names mentioned belong to their respective owners. wecade is not affiliated with, endorsed by, or sponsored by them.
8. Warranties and liability
The Application is provided "as is". The Publisher does not guarantee the absence of bugs or compatibility with all games or devices.
To the extent permitted by law:
- the Publisher is not liable for content imported by users or for the use they make of it;
- the Publisher is not liable for the content of advertisements or for third-party sites or services to which they link;
- the Publisher is not liable for loss of data or saves, or for damage to the user's device;
- nothing in these terms excludes or limits liability that cannot be excluded or limited by law, in particular toward consumers.
9. Distribution
The Application is distributed via Google Play, whose terms apply in addition for downloads, updates, payment, and any refunds.
The purchase of Platinum features is handled by Google Play: payment, invoicing, and any refund request are governed by its terms and applicable law, including consumers' right of withdrawal. The purchase is tied to your Google account and can be restored on your other Android devices through that same account.
10. Termination
You may stop using the Application at any time by uninstalling it. If you breach these terms, your license terminates automatically.
11. Changes to these terms
The Publisher may modify these terms. The applicable version is the one published on wecade.co at the time of your use; in the event of a material change, notice will be given in the Application or on the website. Continued use constitutes acceptance.
12. Governing law and disputes
These terms are governed by French law. Subject to mandatory rules protecting consumers, the courts of Bourg-en-Bresse have jurisdiction.
